Court Of Appeal Hears Sentencing Of Tipperary Drug Dealer Unduly Lenient.

The State has informed the Court of Appeal that a five-and-a-half-year jail sentence, latter imposed on a Tipperary resident caught with over €1 million in cash and drugs, was too lenient.

Mr James Curtis, aged 51 years, with an address at Reiska, Kilcommon, Thurles, Co Tipperary, had been sentenced in October last (2021), at Nenagh Circuit Criminal Court.

The court heard that while serving a suspended sentence, under the cover of darkness, Mr Curtis was discovered near a wood, close to his home, in possession of a potato bag containing 5kg of cocaine.
The court further heard that Gardaí had also discovered €41,000 in cash and a further 4.25kg of cocaine, in a barrel buried in a field; together with a plastic shopping bag containing €336,000.

Mr Curtis had pleaded guilty to possessing €647,000 worth of cocaine for sale or supply, (contrary to Section 15 of the Misuse of Drugs Act). He also pleaded guilty to being in possession of €376,550, knowing or being reckless as to whether the money was the proceeds of criminal conduct. He had been jailed for five and a half years.

Yesterday, at the Court of Appeal, Mr Thomas O’Malley (Senior Council for the State), said the sentencing judge, Mr Justice Cormac Quinn, had erred in principle.
Mr O’Malley claimed that the sentence was too low and unduly lenient, since Mr Curtis was already on a suspended sentence for a similar offence and his sentence therefore should not have been less than 10 years in prison, despite his admitting to the offence.

The matter has now been adjourned until Friday next, when the court should be in position to give a further judgement.

Death Of May Doherty, Thurles, Co. Tipperary.

It was with a great sadness that we learned of the death today, Monday, 25th July 2022, of Mrs Mary (May) Doherty (née Cullagh), Longorchard, Templetuohy, Thurles, Co. Tipperary.

Pre-deceased by her husband Ned; Mrs Doherty passed away peacefully, aged in her 89th year.

Her passing is most deeply regretted by her loving daughters, Aine, Eileen and Mary, sons-in-law, Tom, John and Willie, sons Denis and Eamonn, daughters-in-law, Ann and Ide, grandchildren, great-grandchildren, nephews, nieces, her brothers and sisters, their wives and husbands, extended relatives, neighbours and friends.

Requiescat in Pace.

Funeral Arrangements

The earthly remains of Mrs Doherty will be received into the Church of the Sacred Heart, Church Lane, Longorchard, Templetuohy, Thurles, on Thursday evening next, July 28th, at 8.15pm.

Requiem Mass will be celebrated on Friday morning at 11:30am, followed by interment immediately afterwards in the adjoining graveyard.

New Covid-19 Recommendations Endorsed By Niac

The Irish Republic’s Minister for Health, Mr Stephen Donnelly made public on yesterday afternoon, that a number of new recommendations have been endorsed by the National Immunisation Advisory Committee (Niac) and also by interim Chief Medical Officer, Professor Breda Smyth.

Five new recommendations include:

  • A second mRNA booster vaccine for healthcare workers.

  • A third mRNA booster vaccine for those aged 65 years and older, and those aged 12-64 years who are immunocompromised.

  • A second mRNA booster vaccine for those aged 12-49 years who have an underlying medical condition or are residents of long-term care facilities.

  • A second mRNA booster vaccine for those aged 50-64 years.

  • A second mRNA booster vaccine for pregnant women at 16 weeks or later who have not already received a booster vaccine in their current pregnancy.

The National Immunisation Advisory Committee has also recommended that Covid-19 vaccinations can be administered at the same time as seasonal influenza vaccines are being dispensed.

The Minister has urged anyone who has not yet received their primary course or booster vaccine, to do so at the earliest possible convenience.
