A Templemore family, named as Jackie Costelloe, Neville Curley and Elizabeth Ann Curley-Poppe, have sued an international undertaker, named as the Spanish-based Memora Servicios Funerarios Internacionales; an English repatriation service, named as Rowland Brothers International Limited, located in Surrey, England; and a funeral home named as Grey’s funeral home, situated in Templemore Co. Tipperary, over alleged psychiatric injuries suffered, due to the mistaken delivery of a body, not their father, who died while holidaying in Spain.
Their late father, Mr Michael Curley aged 83 and a widower, sadly died unexpectedly of a heart attack, while on holidays in Lanzarote, back in February of 2016, the High Court has now heard.
Senior counsel, representing the family, has spoken of the circumstances his three clients experienced, arising out of the three named defendants’ negligence and breach of contract. The defendants have each filed a full defence, denying all/any liability in this case.
Ms Costelloe was with her father at the time of his death in the Spanish resort and viewed his body over there. Mr Neville Curley flew out and attended at the Lanzarote funeral home, also observing his father’s body. Both parties then made arrangements for repatriating his body back to Ireland.
Mr Neville Curley went to visit the body at Grey’s Funeral Home, Templemore, Co. Tipperary and was informed that he should prepare himself for a shock, as his father did not look good and foreign embalming services were not as good as Irish ones. Mr Curley was shocked by the appearance of the body, as were his siblings when they later also attended at the funeral home.
Later that day Mr Neville Curley was summoned to return to the funeral home, following the discovery of a body tag on the deceased, which identified that the body received was that of a French citizen. The deceased bore no resemblance to the late Mr Curley. The body mistakenly received had jet black hair, with cuts to his face from shards of glass and had undergone an autopsy, which Mr Michael Curley had not.
The family had asked the undertaker, on three occasions, if he was sure that this was their father, to which the undertaker had responded that it was; based on the paperwork he had been provided with. They decided then that the coffin should be closed, without the body being dressed.
On recognising the error, this grave mistake was quickly rectified, thus enabling the late Mr Curley’s funeral to go ahead as was previously scheduled.
The case before Mr Justice Tony O’Connor will continue today.
Why Should Thurles Consumers Be Concerned?
Almost two weeks on and Uisce Eireann (Irish Water) has confirmed that it cannot give a conclusive date with regards to the lifting of the Thurles Regional Boil Water Notice*. [*Note: Three consecutive days of satisfactory results are required before the notice can be lifted.]
The Thurles Regional Public Water Scheme Boil Water Notice was publicly announced first on July 14th last and impacts on some 12,000 consumers. Irish Water have confirmed that work remains ongoing in their efforts to resolve the current issue, which necessitated this unexplained Boil Water Notice.
While Thurles consumers wait for an explanation as to what has caused this Boil Water Notice; last weekend anxious consumers, especially those with very young children, found themselves unable to purchase 5L size bottles of water from local outlets and were forced to instead purchase the more expensive 750ml small bottles. This issue in supermarkets has now been corrected and this morning 5L bottles of ishka (manufactured next door in Co. Limerick) have appeared on the shelves. Consumers however are advised to shop early in the morning to ensure supply.
Meanwhile, elderly people with no availability to social media, have continued and in some cases are still continuing to use the non-boiled water, unaware of the Boil Water Notices currently being in place. Note: No leaflets were posted through letterboxes warning of this serious issue and no alternative supply was put in place.
Meanwhile, Irish Water has stated that it greatly regrets any inconvenience caused to the individual homes and businesses in the Thurles community.
It was with great sadness that we learned of the death, yesterday Monday 24th July 2023, of Mrs Teresa (Tessy) Fogarty (née Hennessy), Ikerrin Court, Thurles, Co. Tipperary and formerly of Graigue, Moycarkey, Thurles, Co. Tipperary.
Pre-deceased by her husband Willie, sister Bernie, brother David, son-in-law Seamus, daughters-in-law Siobhán and Mary; Mrs Fogarty passed away peacefully at her home, under the wonderful care of her family and excellent carers, especially Geraldine.
Her passing is most deeply regretted by her loving family; daughters Noirín, Mary and her partner Leonard, Evelyn and her partner Geoff, sons Jerry, Billy, Paddy and David, daughters-in-law Susan and Catherine, brother Liam, sisters-in-law Eileen and Helen, grandchildren Caitríona, Aoife, Niamh, Meadhbh, Neasa, Andrew, Emmet and Matthew, great-grandchildren Mina, Freddie, Summer, Finley and Oscar, nephews, nieces, extended relatives, neighbours and a wide circle of friends.

The earthly remains of Mrs Fogarty will repose at Hugh Ryan’s Funeral Home, Slievenamon Road, Thurles on Wednesday afternoon, July 26th, from 5:00pm until 7:00pm same evening. Her remains will be received into the Cathedral of the Assumption, Cathedral Street, Thurles on Thursday morning July 27th at 10:30am to further repose for Requiem Mass at 11:00am. Interment will take place immediately afterwards in St. Peter’s Cemetery, Moycarkey, Thurles.

Warning to motorists travelling westward on Cathedral Street in Thurles. Same are being warned that the pedestrian crossing traffic lights have once again been seriously adjusted by possibly some unknown high sided vehicle for the umpteenth time.
Same as shown in picture above now has its Red, Green and Yellow lighting system indicators facing north rather than west. Same is particularly dangerous coming onto evening with the setting sun.
This brings to four the number of pedestrian crossing traffic light system constantly being damaged on a regular basis here in Thurles, and all due to the fact that same are erected too close to moving two lane traffic.
The waste of taxpayers’ money by engineers continues unabated.
It was with great sadness that we learned of the death, on Sunday 23rd July 2023, of Mr Patrick O’Halloran, “The Forge Cottage”, No. 4 Clohessey Place, Inch, Bouladuff, Thurles, Co. Tipperary.
Pre-deceased by his brother Johnny and recently by his sister Mary and brother Rodge; the passing of Mr O’Halloran is most deeply regretted by his loving wife Hannah, their family, Joanne, Thomas, Breda and Patricia, sons-in-law Michael, Luigi and Kevin, daughter-in-law Nikola, grandchildren Michelle, Leanne and Annie-Rose, extended relatives neighbours and friends.

Requiem Mass will be celebrated on Thursday morning at 10:00am, followed by private cremation at Shannon Crematorium, Illaunmanagh, Shannon, Co. Clare.
